Private Message

Knowing one's rights is NOT gaming the system. In fact, no one in my house has ever "gamed the system". There is not a thing wrong with standing up for one's self in court, and demanding a jury trial, and that is what the defendant did. He also won. If you had graduated from a school that teaches the basics and employs decent teachers, you would know that.

Teachers and county attorneys who sit on the internet all day and collect paychecks for surfing social media sites actually do game the system. Their jobs do not include recreational internet play and games. If you are so upset about the disposition in the above mentioned case, why not take the county attorney to task for gaming the system by spending all of the taxpayers' time online, rather than doing her job? Or if you are angry that you don't understand your rights when faced with injustice or false accusations, why not insist upon public schools staffed by teachers who teach, rather than gaming the system by doing things other than teaching. Outside of Northeast Kansas, most children understand the judicial system by third grade.

Spanish Fork Utah And Frankfort Kansas

 
Kiplyn Davis, or Spanish Fork, Utah, was last seen Spanish Fork High School some time after lunch, on May 2, 1995. She was fifteen years old, and when she did not show up for her afternoon classes, no one batted an eyelash. In fact, no one even considered her absence odd, until her parents couldn't find her. They reported her missing at 5:00 that evening, but it took police about three weeks to start looking for her. To this day, she has not been found.

Because of the publicity the case receives from time to time, law enforcement and the local prosecutors occasionally speculate about what happened, and a former classmate is serving about fifteen years for manslaughter in the case; a guilty plea was accepted without the requirement that he name the person he "saw" murder Kiplyn or reveal her location. Such is justice when children disappear from small Midwestern schools.

But what does that have to do with Frankfort, Kansas? There is a small school there, too. There was also an incident involving a child who disappeared; thankfully, that child was found. But some of the elements are very similar to the Spanish Fork case. The child who disappeared from Frankfort High was a female freshman who had been abandoned by herself alongside of a highway by a guidance counselor who doubled as a track coach. When she disappeared, he looked for her a little bit, but gave up after awhile. He did not bother to call her parents or the police. After about three or four hours, someone noticed her walking on the shoulder of the highway and gave her a ride back to Frankfort. And now for the most disturbing similarity: Frankfort is largely populated by humanoid creatures who call themselves "people" who actually do not think that a coach or teacher "losing" a student and failing to call law enforcement or let the appropriate people know she is missing is dangerous or criminal! Had that child not been offered a ride by a person with good intentions, but found by someone with bad intentions, or had remained missing, the above mentioned humanoid creatures probably would never have tried to find her, or even tried find out what had happened. The fact that this freshman was not a native "Frankforter" disentitled her to basic safety and consideration. Tom Schroeder, the coach in question, is still employed at the school. Laura McNish, the Marshall County prosecutor, apparently does not have a problem with teachers who turn children into statistics.

On February 11, 2011, Timothy Brent Olsen entered a guilty plea to manslaughter in the disappearance of Kiplyn Davis. This was sixteen years after the last time Kiplyn was seen alive. The court did not require that he name his accomplices, and the court did not require that he reveal the location of Kiplyn's body. Had the child who was "lost" by Frankfort High School, in Kansas become a statistic, the faculty at Frankfort High School and the county attorney would probably not care about justice, or about finding her, either. They certainly didn't care about finding her during the first three hours she was missing.

Selective Application Of Laws In Marshall County, Kansas

"EQUAL PROSECUTION. CM spoke about an example of a juvenile crossing private property cutting donuts with a vehicle. She talked about prosecution and restitution and asked why some people are singled out for the exact crime and some are not. CA McNish said Municipal Court has no jurisdiction over juveniles. CM asked CA McNish to comment on fair and equal prosecution in town. CA McNish said he has been more than fair. No decisions were made."

Above is a quote from a recent city council meeting in Marysville, Kansas.  City Attorney (CA) McNish was asked a direct question about underage drivers, often unlicensed, driving through  fields, lawns, and gardens, and occasionally running over mailboxes. Marshall County Kansas will often throw the book at a teen for this, but then, sometimes not. City Attorney McNish spoke truthfully enough when he stated that the city of Marysville has no jurisdiction over juveniles, but what he did not discuss is the fact that his spouse, Laura McNish, is the county attorney, and it is the office of the county sheriff who would handle the arrest of a juvenile tearing up a lawn or field with a vehicle, or the arrest of a juvenile drinking alcohol. Often enough, children who do these things are duly prosecuted, but what happens if an underage witness, in a case against someone else being tried by the county attorney, is caught drinking beer? As it happened in May of 2013, the underage witness was not arrested, even though she was obviously drunk. Her changing testimony at the trial, which, by the way, the county attorney lost, was deemed too important to risk losing her cooperation by arresting her, as indicated by the law. What happens if the driver of a vehicle being driven over private property, and destroying the same, belongs to the son or daughter of someone in a position of authority in Marshall County or Marysville, Kansas? Do those young people live by the same rules? Apparently, a portion of the citizenry in Marysville think not; otherwise the question would not have been brought up at a city council meeting. County Attorney is an elected position, here in Kansas, and selective application of laws is not a way for elected officials to remain in office.

The Kansas Judicial Branch site has this to say about personal and public matters involving lawyers:

[5] A lawyer's conduct should conform to the requirements of the law, both in professional service to clients and in the lawyer's business and personal affairs. A lawyer should use the law's procedures only for legitimate purposes and not to harass or intimidate others. A lawyer should demonstrate respect for the legal system and for those who serve it, including judges, other lawyers and public officials. While it is a lawyer's duty, when necessary, to challenge the rectitude of official action, it is also a lawyer's duty to uphold legal process.

Your County Prosecutor Might Have An Ethics Problem If

Your county prosecutor might have an ethics problem if:

►She cherry picks juries to consist of close friends and relatives of plaintiff.

►She knowingly charges people with crimes they did not commit.

►She falsely claims she does not have evidence that she does, indeed, possess when discovery is requested, only to reveal, at trial, that she has the very same evidence, and has had it all along.

►She targets random people by calling as many of their friends and associates as she can find, threatening them with legal action if they continue friendship with her "target".

►She continuously becomes entangled in cases from which she has been recused due to conflicts of interest.

►She bribes witnesses or threatens witnesses, depending on her needs, in order to compensate for her lack of litigation skills.

►She spends all day on Facebook and other social media sites, while sitting in her taxpayer funded office.

►She attempts to bias judges using information unconnected to any case from said social media sites.

►She orders law enforcement to refrain from arresting underage drinkers who are prosecution witnesses in current cases she wants to try.

►She destroys her own property in order to gain attention and sympathy.

►She blatantly lies in court.

►She uses law enforcement as her personal goons, while others need law enforcement for legitimate reasons.

►She attempts to use federal law enforcement agencies to attempt stop malcontents from photoshopping her picture.

►She does not understand the first amendment.

►She instructs local law enforcement to use violence against victims of domestic violence, in order to ensure that they will testify.

►She threatens the security of children in order ensure that mothers will testify, or testify falsely, to suit her agenda.

►Her prejudiced tendencies interfere with her judgment, her job performance, and her ability to be impartial and fair.

All of those flaws are symptoms of two major problems when found in elected prosecutors. Obviously, any fighter who resorts to dirty or dishonorable means in order to win does so because he is either not entitled to the title of "winner", or unskilled and unequipped badly enough to lose in any skirmish. Both are disconcerting in a county or district attorney. Another problem that should not be overlooked by voters in a locale wherein such persons as prosecutors are elected is the moral issue. Remember what rolls downhill? This happens when corrupt and dishonest officials at the top run rampant, unchecked. It is bad enough when a dishonest congressman or senator is bought, but a county prosecutor can be used by rich and prominent bullies within a community to harm and ruin the lives of those who are not wealthy enough, or otherwise equipped, to stand up for themselves. Such officials are bad for the communities the allegedly serve.

There IS help for such individuals. The help often comes in the form of an official complaint to the bar association. In the event that your county attorney is elected, help can also come in the form of a recall or an impeachment, should the bar association take it's sweet time to pull the license of such an individual. Help also can come in the form of a lost election, should an opponent and informed voters prevail. Chronic failures in personal and professional ethics on the parts of elected officials, especially within law enforcement and the court system, are serious. The community should not ignore it.

Dalinghaus Say "Bye-Bye, Money!"

 
After my decision to enroll my children in a different school than the local public school, I got this letter:

"The Board of Education of USD 380 approves and supports the intent of KSA 72-1113 which recognizes that regular school attendance is essential to the complete education of each student. Truancy is defined as any three consecutive unexcused absences, any five unexcused absences in a semester or seven unexcused absences in a school year, whichever comes first. Since we have received no records for A, B, or C, they in turn have seven unexcused absences since the beginning of  school. We have received records requests for D and E. If A, B, and C have been enrolled in another school we need a records request from that institution, or if you have decided to home school them, you will need to register with the Kansas State Department of Education. If you choose to do neither, the truancy report will be continued by the county attorney.

Once a report is filed with the county attorney, an investigation shall begin. If the county attorney
determines that your child is not attending school as required by law, the county attorney shall prepare and file a petition alleging that your child is a child in need of care. If, during the investigation, the county attorney determines that a criminal investigation is necessary, the county attorney shall commence the same. If there is anything we need to know about their attendance, feel free to call me at the school to discuss it at 785-292-4486. Dean Dalinghaus, Principal"

My, my. Dean Dalinghaus is really having a hard time saying "Bye-Bye" to the money which was brought into the school by the enrollment of my six children. I went ahead and corrected his spelling errors and his grammatical errors, but left his badly punctuated sentences as he wrote them. I also substituted the names of my children with sequential letters of the alphabet. I guess I should begin the rebuttal of Dalinghaus's nonsense at the beginning, in the first sentences. I agree that regular attendance is essential to complete education, but so is presence, and when my daughter was missing, rather than present, for a whole afternoon because the guidance counselor abandoned her alongside a highway four miles south of the school, then failed to tell anyone when he could not find her, Dalinghaus was not at all concerned about my daughter's absence. Why is he so concerned about anyone's absence now? We all know the answer to that: enrollment dollars! Dean Dalinghaus is an enrollment dollar whore! But the truth is, my children have not been truant or absent at all, because they attend a different school. Their transcripts were obtained via the superintendent before school started, because no one cared to countenance the sight of Dean Dalinghaus and his silly and annoying et els at Frankfort School, especially after seeing friends, family and others over the summer, who are nicer than Frankfort School staff and do not look and act like carbon copies of each other.

The second silly-assed notion entertained by this principal is that he ought to file a report with the county attorney about our choice of a different school! While the county attorney, sure enough, hates my guts, (hahahahahaha!) she has her own problems with the Kansas Bar Association, at the moment. Chances are, she did not share that information with Dean Dalinghaus, but investigating yours truly for failing to commit a crime is probably not on her agenda, and probably not the best career move for our county attorney, at this time. Not that such a thing would ordinarily stop her, but she may wish to hang on to her ability to practice law!

The idea that a parent is obligated, by law, to use a public school is incorrect. A parent may send children to boarding school, private school, correspondence schools, internet schools, private tutors, or home school. When one tries another brand of toothpaste, the marketers of the former brand do not harass the consumer over the new preference. When one trades in a vehicle, and purchases a different make, there are no threats of arrest from the makers of the old vehicle. One is even free to change cable companies, buy a different cell phone, or go elsewhere for medical care! Dean Dalinghaus's opinion that I owe my patronage to his sorry excuse for a school is akin to MSN trying to tell  customers that they MUST stick with Windows 98, no matter which computer is selected! I don't have to send my children to Dean's racist, substandard institution, where bullies rule and teachers serve beer to students at their homes! (two teachers of whom I personally know, although the number is probably higher) I also do NOT have to send my children to a school where the guidance counselor buys cigarettes for children on field trips. Yes, folks, that actually happened. And as for the guns that go into the building or wait in vehicles belonging to students during hunting season.......yes, it happens at Frankfort.........no loving parent knowingly exposes a child to that!

Seriously; the best thing Dean Dalinghaus can do for Frankfort School is resign, after making a recommendation of permanently closing it to the school board. The best thing he can do for himself is to get over himself, stop harassing customers who have taken their business elsewhere, relax, and say "Bye-Bye, Money" to the funds which would have been earmarked for his institution, had he chosen to treat me with respect.

Duties Of Schools Boards And County Attorneys

Oh yes! The Kansas State Board of Education is now in the process of revoking six teaching licenses of teachers who, the Board discovered, had felony criminal records. The crimes in question have mostly been abuses of children, but at least one was a violation of a prohibition law. According to Cheryl Whelan, the attorney who represents the Kansas State Department of Education, the State Board of Education has a responsibility to make sure that no teacher renews a license after conviction of certain crimes, and that no new license is granted to a felon. An interesting additional comment she made is this: “There doesn't have to be a conviction,” she said. “It can be any act that endangers or injures the health or welfare of a minor through physical or sexual abuse or exploitation. The perception that a conviction triggers a duty to report is incorrect.” That means that if a teacher has committed a crime that has not been reported or prosecuted, which often happens in these parts because of corruption and judicial favoritism, and if criminal acts on the part of a teacher have been admitted, or can be proven to the satisfaction of the Board, the license in question should not be renewed, if the Board is following the law to the letter. That certainly is intriguing, considering that in 2009, a guidance counselor deliberately dropped my daughter off on a stretch of highway and never contacted law enforcement or yours truly. Luckily, she was found several hours later. Because of the danger this type of action on the part of a teacher presents, I reported it, yet no one wanted to do anything about the creepy guidance counselor's criminal act toward my daughter. This brings me to the other point made by Cheryl Whelan about the ability and responsibility of the Kansas Board of Education about revocation of teaching licenses when teachers prove unworthy. The misdeeds get swept under the rug, so to speak, in much the same way district and county attorneys manipulate testimony and evidence for cases here in Kansas. Oddly enough, Whelan has the notion that the Board of Education's agency for hearing these cases, the Professional Practices Commission, does not get the cooperation it needs in order to serve the schools and children properly. She complains that the "agency has often had trouble enforcing those laws because school districts and local prosecutors often failed to report cases to state licensing officials." Imagine that! In the state of Kansas!

What's most amusing is that Whelan calls the situation "the new normal". New?

Fishy Fishy



The data recorded below represents the "work" done by the County Attorney of Marshall County, Kansas, during a typical day. All of this time was spent perusing the internet over an "obstruction of justice" case, when the Marshall County judicial system has plenty of cases that involve more serious crimes. There isn't any evidence in this case, and the attorney is fishing for some. No pun intended, McFish. It must be nice to play on the internet all day, while actual work, involving more serious matters, remains undone. This should also put to rest any rumor that the prosecutor of Marshall County is overworked. It is abundantly clear that the opposite is true.
